By using this site and making use of CyberBlader VPN, a service offered by Naroro, Inc. ("the Company"), you agree to abide by the following Terms and Conditions. These Terms and Conditions cover all present and future features offered by your CyberBlader VPN account, individually and collectively referred to as the "Service".

Users of the Service

This Service is provided exclusively to individuals who are at least 18 years of age, or to minors who have obtained parental or legal guardian consent to open and maintain an account.

This Service is provided exclusively to persons. Accounts registered by “bots” or automated methods are not authorized and will be terminated.

Each user is solely responsible for all of his or her actions related to the use of the Service.

Usage Policy and Prohibited Activities

The Service cannot be used for activities prohibited by U.S. law. To protect its services from being misused, abused or being used to harm someone, the Company enforces some rules which apply to every user equally, regardless of the type of subscription. You specifically agree not to use this Service for:

  • Accessing/sharing/downloading/uploading illegal content, including, but not limited to, child pornography or content perceived to be child pornography;
  • Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • Sending or transmitting unsolicited advertisements or content ("Spam") over the Service, via e-mail or any other communication channel;
  • Attempting to access, probe, or connect to computing devices without proper authorization (i.e., any form of “hacking”);
  • Infringing upon or violating our intellectual property rights or the intellectual property rights of others;
  • Promoting illegal activities, or providing means for/helping other people commit illegal activities by providing instructional information;

The account of any user found involved in any of the aforementioned activities will be suspended immediately without notice. Additionally, you may be held responsible for any and all damages incurred by the Company, including any amounts charged by any outside entity due to said violation(s), including without limitation attorney's fees and costs.

Having multiple free accounts is not an acceptable use of the service. Free accounts can also only be created and maintained by their effective users (e.g. it is not acceptable to create accounts in anyone else's name and later transfer credentials to that third party). The Company reserves the right to take action against any free account which it considers abusive in that regard.

We reserve the right to suspend or delete accounts that are inactive for over one year. Paid accounts with active paid status are not subject to this measure.

Limited Warranties and Liability

The Company does not make any warranty about the reliability of the Service and does not guarantee the security of user data despite best efforts. The Service is provided “as is” and you agree neither to hold the Company responsible nor to seek indemnification for any damages that may arise as a result of the loss of use, data, or profits connected to the performance of the Service or failure in such performance.

The Company does not control, nor is responsible for, any data, content, services, or products (including software) that you access, download, receive or buy while using the Service. Furthermore, you will not hold the Company liable or seek indemnification if confidential material is unintentionally released as the result of a security failure or vulnerability in the Service.

The Company will attempt to make the Service available at all times; however, VPN service coverage, speeds, server locations and quality may vary. The Company is not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks. The Company may impose usage or service limits, suspend service, or block certain kinds of usage at our sole discretion.

The CyberBlader VPN website may contain links to other websites of interest. However, The Company is not responsible for the content of any website that it links to, and external sites are governed by their own terms and conditions and privacy policies.

The Company may make improvements and changes to the Service at any time without notice. The Company may at its sole discretion terminate service without cause or notice.

Indemnification

You agree that the Company and any parents, subsidiaries, officers, employees, or third-party contractors cannot be held responsible for any third-party claim, demand, or damages, including reasonable attorneys' fees, arising out of your use of this Service.

Privacy policy

CyberBlader VPN's Privacy Policy (https://cyberblader.com/tos.html#privacy) explains the way the Company handles and protects your personal data and privacy in relation to your use of the Service and your browsing of the cyberblader.com website. By agreeing to the present Terms and Conditions and to be able to use the Service, you agree to our Privacy Policy.

General terms of payment

The Company reserves the right to discontinue service immediately if a fraudulent payment is detected, such as the use of a stolen credit card, and such cases may be further referred to the competent authorities.

Subscriptions

By subscribing to the Service, you agree to become a subscriber for the period you have selected (such as 1 month or 1 year). All plans renew automatically at the completion of the billing term. The renewal term is by default for the same duration as the billing term for the original subscription.

If you fail to fulfill your obligation of payment as a user of a paid account, the Company may suspend your account or delete it after an extended period of default.

Modifications to Terms of Service

Within the limits of applicable law, the Company reserves the right to review and change these Terms and Conditions at any time. You are responsible for regularly reviewing these Terms and Conditions. Continued use of the Service after such changes shall constitute your consent to such changes.

The Company reserves the right, at its absolute discretion, to modify the Service, for example by adding or removing certain functions of VPN servers or by updating the software.

The Company may, at its sole discretion, provide limited technical support, upgrades and updates for the Service. In order to enhance and further develop the Service, the Company may automatically download and install updates and upgrades from time to time. You, as a user, agree to receive such updates and upgrades as part of your use of the Service. The Company shall have no obligation to provide support or maintenance for the Services under this Agreement.

Applicable Law

You agree that these Terms, and your use of the Services, are governed exclusively by the substantive laws of the State of Delaware without regard to its rules of conflict of laws. The parties hereto hereby irrevocably and unconditionally consent to and submit to the exclusive jurisdiction of the courts of the State of Delaware and of the United States of America located in such state (the “Delaware Courts”) for any litigation arising out of or relating to this Agreement and the transactions contemplated hereby (and agree not to commence any litigation relating thereto except in such courts), waive any objection to the laying of venue of any such litigation in the Delaware Courts and agree not to plead or claim in any Delaware Court that such litigation brought therein has been brought in any inconvenient forum.

Philosophy

Our Company is committed to protecting and respecting your privacy. It is our overriding policy to collect as little user information as possible to ensure a private and anonymous user experience when using the Service. Below is a summary of the way we deal with information when you use the Service.

CyberBlader VPN is a No-Logs VPN service

When you use the Service, we do NOT do any of the following:

  • Log users’ traffic or the content of any communications
  • Discriminate against devices, protocols, or applications
  • Throttle your Internet connection

Data we collect and why we collect it

Personal data (related to your account):

Account creation: To create an account, in order to use our Service, we do not ask your name or surname. All you need to do is select your username, then provide the email address and choose your password.

We do store the email address you have entered when creating an account for communication and anti-abuse purposes. If you are referred to the Service by a friend or some other third-party who is participating in our referral program, we may associate your account with the referrer to appropriately credit the referrer.

Support: When you submit support requests or bug reports, we will collect the data that you choose to share with us about the issue being reported. Bug reports sometimes rely on third parties, such as Chatwoot

Payment: The Company relies on third parties to process credit card and PayPal transactions, and we do not save your full credit card details. For example, if you make a payment with a credit card, your name and the last 4 digits of the credit card number will become part of the invoice and saved by us.

How we use this personal data: Your email address is not shared with any third parties. We mainly use it for account-related questions, communication, and recovery. By signing up to our Service, you agree to receive communications from us, which may include promotional emails too. You can stop receiving emails from us by following the unsubscribe instructions included in every email we send.

We might also use your data for payment-related matters. This includes sending you emails, invoices, receipts, notices of delinquency, and alerting you if you need to update payment details. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your credit card payments.

Non-personal data (cyberblader.com website and our native applications)

Visiting our website: We only use analytics software to collect aggregated non-identifying information, such as: title of the page being viewed, screen resolution, outlinks, referrers, and page and website speed. This data cannot be used to personally identify users or visitors as we do not log IP addresses and connect them to specific user accounts.

Why we use analytics software: We use analytics software to help us deliver a higher quality of service. For instance, looking in aggregate at the geographic distribution of the Service's users allows us to understand which countries have the most need for the Service and allocate development resources towards providing the best service in those countries. Viewing longer term trends in the number of visitors from different countries also allows us to identify quickly which countries have started to block the Service and take measures to counteract those blocks.

How do we collect non-personal website data: We may use various cookies to collect and store information when you visit our website. Users can control the use of cookies at the individual browser level.

Using our native applications (apps)

When you use our native apps, we may collect certain information in addition to the information mentioned elsewhere in this Policy. We may use mobile analytics software (Play/App Store app statistics or self-hosted/open-source Sentry crash reporting) to send crash information to our developers so that we can fix bugs rapidly. Some platforms (such as the Google Play Store or the Apple App Store) may also collect aggregate, anonymous statistics, such as which type of devices and operating systems are most commonly used (e.g. percentage of Android 6.x vs Android 7.x), the total number of installs, total number of uninstalls, and the total number of active users, and may be governed by the privacy policy and terms and conditions of Google Play Store or Apple App Store.

None of the software on our apps will ever access or track any location-based information from your device at any time.

Social media: We are active on Facebook and Twitter. Any information, communication, or material you submit to us via social media platforms is done at your own risk without any guarantee of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

Links to other websites: Our website may contain links to other websites of interest. However, we are not responsible for the content of any website that we link to, and external sites are governed by their own terms and conditions and privacy policies.

Data security

We take data security very seriously. Access to our infrastructure and Secure Core servers is tightly controlled. All of the CyberBlader VPN servers are encrypted and we do not log VPN session data. Offline backups may be stored periodically, but these are also secured.

Disclosure of your information

We will only disclose the limited user data we possess when compelled by law for the purposes of the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security. Foreign authorities' data requests must be approved by competent Swiss authorities.

Under US law, it is obligatory to notify the target of a surveillance request, although such notification may come from the authorities and not from the Company.

Age Limitations

To the extent not prohibited by applicable law, we do not allow the use of our Services, Products and Website by anyone younger than 18 years old. If you learn that anyone younger than 18 has unlawfully provided us with Personal Data, please contact us and we will take steps to delete such information.
